Renters' Rights Act: What's a Written Statement

We are another step along the road to the implementation of the Renters’ Rights Act as yesterday the Government published a draft Written Statement for the Act. 

 

For new tenancies entered on or after 1 May 2026, tenants must be provided with the Written Statement of Terms and Information prior to signing the tenancy agreement.

 

Information must include:

 

·      Contract identity and contacts – this includes the landlords’ names, tenants’ names and an address in England or Wales where notices can be served on the landlord by the tenant.

 

·      The property address and the date that the tenant is first entitled to possession under the tenancy.

 

·      Financial terms, including the rent details, a statement explaining how rent increases will be notified, any relevant bills are to be paid, and details about the deposit.

 

·      Notice provisions, including the minimum notice period for the tenant and a statement of security of tenure for the tenant.

 

·      Statutory duties and safety obligations.

 

·      Any additional information such as pet consent rights or disability adaptations.

 

From 1 May 2026 failure to provide a compliant written statement expose landlords to enforcement action, so we will be incorporating this into our practices to ensure that as a landlord you are covered. 

 

For tenancies created before 1 May 2026, tenants won’t need to be issued with a new tenancy agreement. Instead, tenants will need to be issued with a government published Information Sheet on or before 31 May 2026. This must be provided to all tenants named on a tenancy agreement, either electronically or by hard copy. Again, we will ensure that this process is carried out for all tenancies under full management with us.
